Living Will in Thailand

A Living Will is a written, legal directive about your preferences for medical care if you are no longer able to make decisions for yourself. Living Wills provide doctors and healthcare professionals with guidance for making decisions in the event that you are terminally ill, seriously injured, in a coma, in the late stages of dementia or approaching the end of life.

Advance planning helps you to receive the medical care you want, avoids unnecessary suffering and removes the burden of decision-making from carers. It also helps to avoid confusion or disagreement about the decisions that should be made on your behalf.

We offer a Living Will template that complies with the legal requirements of the
Thai National Health Act B.E. 2550 (2007) and is in accordance with the rules and procedures prescribed in the Ministerial Regulations.

Section 12, Thai National Health Act
A person shall have the right to make a living will in writing to refuse the public health service which is provided merely to prolong his/her terminal stage of life or to make a living will to refuse the service as to cease the severe suffering from illness.

The living will under paragraph one shall be carried out in accordance with the rules and procedure prescribed in the Ministerial Regulation.

An act done by public health personnel in compliance with the living will under paragraph one shall not be held an offence and shall not be liable to any responsibility whatsoever.

Content of a Living Will

Our Living Will contains personal data of the declarant, the date on which a living will is written, health care services that the declarant refuses, information about a witness and, if applicable, about the representative(s) and the author.

Health Care Services

In our Living Will template, we have listed common medical treatments that some people may wish to refuse. Please read through it and decide for yourself whether or not you would want to receive such treatment(s). We can as well add other medical treatments according to your preference.

Representative(s)

The person who has written a Living Will may appoint their representative(s) who, in the name and on the instructions of the person who has written a living will, may, in case of doubt, describe the treatments to be taken or make health care decisions.
The authorized representative(s) must also sign a Living Will.

We can provide a witness if you do not have your own. It is not mandatory to appoint the representative(s), however, we recommend to do so.

Fee

Our fee for the preparation of a Living Will is 2,500 THB. We offer a Living Will in two bilingual versions: Thai – English and Thai – German.
